WHICH PERSONAL DATA DO WE PROCESS AND FOR WHAT PURPOSE?

We store your personal data only in media to which authorized persons have access. We destroy your personal data if the purposes that justify our processing of your data disappear. Your personal data is transferred to authorized institutions and organizations, business partners and agencies in Turkey, as well as to our Microsoft 365 and Shopify business partners abroad.

ARTICLE 2
SUBJECT
The subject of this agreement is to determine the rights and obligations of the parties in accordance with Law No. 4077 on the Protection of Consumers and the Regulation on Distance Contracts dated 06.03.2011, regarding the sale and delivery of the product ordered by the BUYER from the SELLER's website, www.sorenbyme.com, which is electronically ordered, along with its specifications and sales price.

ARTICLE 3
PRODUCT DETAILS

The basic characteristics of the goods or services are provided on the website www.sorenbyme.com. The listed prices and advertisements are the sales prices. Advertised prices and offers remain valid until updated or changed. Prices announced for a specific period are valid until the stated deadline. The total sales price of the product, including all taxes, is shown in the table below.

3.3 - DELAY INTEREST
As payment is made either in advance or via credit card, no delay interest will be applied by the SELLER.

ARTICLE 4
GENERAL TERMS

4.1) The BUYER declares that they have read and are informed about the basic properties of the product, the sales price, and the payment method and delivery terms via the www.sorenbyme.com website, and they have confirmed this electronically. By confirming the pre-information electronically, the BUYER affirms that they have obtained all necessary information, including the address of the SELLER, basic features of the ordered products, their price including taxes, payment, and delivery information, and have received this information completely and correctly.

4.2) The product will be delivered to the BUYER or the person/entity designated by the BUYER, within the period specified in the pre-information, depending on the distance of the BUYER's residence, and not exceeding the legal 30-day period.

4.3) The SELLER cannot be held responsible for any issues that the shipping company may encounter during the delivery stage, which may prevent the delivery of the ordered product to the BUYER.

4.4) The SELLER is responsible for delivering the product in sound condition, complete, in accordance with the specifications mentioned in the order, and with any warranty certificates and user manuals if available.

4.5) If the SELLER is unable to fulfill its obligations under the agreement before the expiration of the fulfillment period, the SELLER may provide an alternative product of equal quality and price with the BUYER's consent.

4.6) If the product or service cannot be delivered or performed due to impossibility, the SELLER must notify the BUYER and refund the total amount paid by the BUYER within 10 days.

4.7) The confirmation of the Pre-Information Form in the electronic environment is a requirement for the delivery of the product. If the product's payment is not made or canceled in the bank records, the SELLER is relieved of its obligation to deliver the product.

4.8) If the product is delivered and the BUYER's credit card is fraudulently or unlawfully used by unauthorized persons (not due to the BUYER's fault), and the payment is not made to the SELLER, the BUYER must return the product within 3 days, at their own expense.

4.9) In case of force majeure events or transportation issues, the SELLER is obligated to notify the BUYER. In this case, the BUYER may cancel the order, request a substitution with an equivalent product, or postpone the delivery until the impediment is resolved. If the order is canceled, the amount paid will be refunded within 10 days.

ARTICLE 5
RIGHT OF WITHDRAWAL
The BUYER has the right to withdraw from the distance contracts regarding the sale of goods without incurring any legal or penal liability, within 7 (seven) business days from the delivery of the product to the BUYER or to the person/entity designated by the BUYER, without giving any reason. In contracts for the provision of services, the withdrawal period begins from the date the contract is signed. If the service has begun with the consent of the consumer, the right of withdrawal cannot be exercised. The costs arising from the use of the right of withdrawal are borne by the SELLER.

To exercise the right of withdrawal, the BUYER must send a written notification via registered mail, fax, or e-mail within 7 business days, and the product must not have been used in accordance with Article 6. The following are required for the withdrawal:

a) The invoice of the product delivered to the third party or the BUYER (if the invoice is issued to a company, the return invoice issued by the company must be sent along with the product).

b) The Return Form on the back of the invoice.

c) The product must be delivered in its original box, packaging, with all accessories, unused and undamaged.

d) The SELLER is obligated to refund the total price to the BUYER within 10 days of receiving the withdrawal notification and to accept the return of the product within 20 days.

e) If the value of the product is decreased due to the BUYER's fault, or if the return becomes impossible, the BUYER must compensate the SELLER for the damage in proportion to their fault.

f) If the withdrawal right results in the cancellation of a shopping voucher or any promotional benefit, the applicable discount will be void.

g) No return will be accepted for end-of-season products; only exchanges for size or gift vouchers are possible.

ARTICLE 6
EXEMPTIONS FROM THE RIGHT OF WITHDRAWAL
The right of withdrawal is not applicable to products prepared according to the BUYER’s personal needs, those that are perishable, or those with an expiration date that is about to pass. Additionally, the right of withdrawal does not apply to opened audio/video recordings, software programs, or computer consumables, as per the Regulation.

ARTICLE 7
AUTHORIZED COURT
For the application of this contract, the Consumer Arbitration Committees and Consumer Courts in the place where the BUYER resides or where the purchase was made are authorized. Complaints and objections can be made by the BUYER to the relevant Consumer Arbitration Committee or Consumer Court in the jurisdiction where the product or service was purchased.

KONU
İşbu sözleşmenin konusu, ALICI'nın SATICI'ya ait www.sorenbyme.com internet sitesi üzerinden elektronik ortamda siparişini yaptığı aşağıda nitelikleri ve satış fiyatı belirtilen ürünün satışı ve teslimi ile ilgili olarak 4077 sayılı Tüketicilerin Korunması Hakkındaki Kanun ve 06.03.2011 Tarihli Mesafeli Sözleşmelere Dair Yönetmelik hükümleri gereğince tarafların hak ve yükümlülüklerinin belirlenmesidir.

MADDE 3
SATIŞA KONU ÜRÜNÜN ÖZELLİKLERİ
Mal ya da hizmetlerin temel özelliklerini www.sorenbyme.com adresinde yer almaktadır. Listelenen ve sitede ilan edilen fiyatlar satış fiyatıdır. İlan edilen fiyatlar ve vaatler güncelleme yapılana ve değiştirilene kadar geçerlidir. Süreli olarak ilan edilen fiyatlar ise belirtilen süre sonuna kadar geçerlidir. Sözleşme Konusu mal yada hizmetin tüm vergiler dahil satış fiyatı aşağıdaki tabloda gösterilmiştir.

Ödeme peşin ya da kredi kartı ile yapılacağı için SATICI tarafından gecikme faizi uygulanmaz.


MADDE 4 GENEL HÜKÜMLER

4.1) ALICI, www.sorenbyme.com internet sitesinde sözleşme konusu ürünün temel nitelikleri, satış fiyatı ve ödeme şekli ile teslimata ilişkin ön bilgileri okuyup bilgi sahibi olduğunu ve elektronik ortamda gerekli teyidi verdiğini beyan eder. ALICI; bu Ön Bilgilendirmeyi elektronik ortamda teyit etmekle, mesafeli sözleşmelerin akdinden önce, SATICI tarafından ALICI'ya verilmesi gereken adres, siparişi verilen ürünlere ait temel özellikler, ürünlerin vergiler dahil fiyatı, ödeme ve teslimat bilgilerini de doğru ve eksiksiz olarak edindiğini teyid etmiş olur.
4.2) Sözleşme konusu ürün, yasal 30 günlük süreyi aşmamak koşulu ile her bir ürün için ALICI'nın yerleşim yerinin uzaklığına bağlı olarak internet sitesinde yer alan ön bilgiler içinde açıklanan süre içinde ALICI veya gösterdiği adresteki kişi/kuruluşa teslim edilir.
4.3) Kargo firmasının, ürünü ALICI?ya teslimi aşamasında karşılaşacağı her türlü sorun nedeniyle, siparişi verilen ürünün ALICI'ya teslim edilememesinden dolayı SATICI sorumlu tutulamaz.
4.4) SATICI, sözleşme konusu ürünün sağlam, eksiksiz, siparişte belirtilen niteliklere uygun ve varsa garanti belgeleri ve kullanım kılavuzları ile teslim edilmesinden sorumludur.
4.5) SATICI, sözleşmeden doğan ifa yükümlülüğünün süresi dolmadan ALICI?yı bilgilendirmek ve açıkça onayını almak suretiyle eşit kalite ve fiyatta farklı bir ürün tedarik edebilir.
4.6) SATICI, sipariş konusu ürün veya hizmetin yerine getirilmesinin imkânsızlaşması halinde sözleşme konusu yükümlülüklerini yerine getiremezse, bu durumu, sözleşmeden doğan ifa yükümlülüğünün süresi dolmadan tüketiciye bildirir ve 10 günlük süre içinde toplam bedeli ALICI?ya iade eder.
4.7) Ürünün teslimatı için işbu Ön Bilgilendirme Formunun elektronik ortamda teyid edilmesi şarttır. Herhangi bir nedenle ürün bedeli ödenmez veya banka kayıtlarında iptal edilir ise, SATICI ürünün teslimi yükümlülüğünden kurtulmuş kabul edilir.
4.8) Ürünün tesliminden sonra ALICI'ya ait kredi kartının ALICI'nın kusurundan kaynaklanmayan bir şekilde yetkisiz kişilerce haksız veya hukuka aykırı olarak kullanılması nedeni ile ilgili banka veya finans kuruluşun ürün bedelini SATICI'ya ödememesi halinde, ALICI kendisine teslim edilmiş olması kaydıyla ürünü 3 gün içinde SATICI'ya iade etmek zorundadır. Bu takdirde nakliye giderleri ALICI'ya aittir.
4.9) SATICI mücbir sebepler veya nakliyeyi engelleyen hava muhalefeti, ulaşımın kesilmesi gibi olağanüstü durumlar nedeni ile sözleşme konusu ürünü süresi içinde teslim edemez ise, durumu ALICI'ya bildirmekle yükümlüdür. Bu takdirde ALICI siparişin iptal edilmesini, sözleşme konusu ürünün varsa emsali ile değiştirilmesini ve/veya teslimat süresinin engelleyici durumun ortadan kalkmasına kadar ertelenmesi haklarından birini kullanabilir. ALICI'nın siparişi iptal etmesi halinde ödediği tutar 10 gün içinde kendisine nakden ve defaten ödenir. ALICI?nın kredi kartı ile yaptığı ödemelerde ise, ürün tutarı, siparişin ALICI tarafından iptal edilmesinden sonra 7 gün içerisinde ilgili bankaya iade edilir. Bu tutarın bankaya iadesinden sonra ALICI hesaplarına yansıması tamamen banka işlem süreci ile ilgili olduğundan, ALICI, olası gecikmeler için SATICI?nın herhangi bir şekilde müdahalede bulunmasının mümkün olamayacağını ve SATICI tarafından kredi kartına iade edilen tutarın banka tarafından ALICI hesabına yansıtılmasının ortalama 2 ile 3 haftayı bulabileceğini şimdiden kabul etmektedir.


MADDE 5 CAYMA HAKKI
ALICI; mal satışına ilişkin mesafeli sözleşmelerde, ürünün kendisine veya gösterdiği adresteki kişi/kuruluşa teslim tarihinden itibaren 7 (yedi) iş günü içerisinde hiçbir hukuki ve cezai sorumluluk üstlenmeksizin ve hiçbir gerekçe göstermeksizin malı reddederek sözleşmeden cayma hakkını kullanabilir. Hizmet sunumuna ilişkin mesafeli sözleşmelerde ise, bu süre sözleşmenin imzalandığı tarihte başlar. Cayma hakkı süresi sona ermeden önce, tüketicinin onayı ile hizmetin ifasına başlanan hizmet sözleşmelerinde cayma hakkı kullanılamaz. Cayma hakkının kullanımından kaynaklanan masraflar SATICI?ya aittir.

Cayma hakkının kullanılması için 7 iş günlük süre içinde SATICI'ya iadeli taahhütlü posta, faks veya e-posta ile yazılı bildirimde bulunulması ve ürünün 6. madde hükümleri çerçevesinde kullanılmamış olması şarttır. Bu hakkın kullanılması halinde,

a) 3. kişiye veya ALICI?ya teslim edilen ürünün faturası, (İade edilmek istenen ürünün faturası kurumsal ise, geri iade ederken kurumun düzenlemiş olduğu iade faturası ile birlikte gönderilmesi gerekmektedir. Faturası kurumlar adına düzenlenen sipariş iadeleri İADE FATURASI kesilmediği takdirde tamamlanamayacaktır.)

b) Fatura arkasındaki İade formu,

c) iade edilecek ürünlerin kutusu, ambalajı, varsa standart aksesuarları ile birlikte eksiksiz ve hasarsız olarak teslim edilmesi gerekmektedir.

d) SATICI, cayma bildiriminin kendisine ulaşmasında itibaren en geç 10 günlük süre içerisinde toplam bedeli ve alıcıyı borç altına sokan belgeleri ALICI?ya iade etmek ve 20 günlük süre içerisinde malı iade almakla yükümlüdür.

e) ALICI?nın kusurundan kaynaklanan bir nedenle malın değerinde bir azalma olursa veya iade imkânsızlaşırsa ALICI kusuru oranında SATICI?nın zararlarını tazmin etmekle yükümlüdür.

f) Cayma hakkının kullanılması nedeniyle SATICI tarafından düzenlenen Alışveriş çeki kullanabilme tutarının altına düşülmesi halinde kampanya kapsamında faydalanılan Alışveriş çeki tutarı iptal edilir.

g) Sezon Sonu Ürün İadesi Yoktur, Yalnızca Beden Değişimi ve Hediye çeki olarak iade işlemi sağlanmaktadır. 

MADDE 6 CAYMA HAKKI KULLANILAMAYACAK ÜRÜNLER
ALICI'nın istekleri veya açıkça onun kişisel ihtiyaçları doğrultusunda hazırlanan, niteliği itibariyle geri gönderilmeye elverişli olmayan ve çabuk bozulma tehlikesi olan veya son kullanma tarihi geçme ihtimali olan mallar ve ALICI tarafından ambalajının açılmış olması şartıyla, ses veya görüntü kayıtları, yazılım programları ve bilgisayar sarf malzemelerinin iadesi Yönetmelik gereği mümkün değildir.

MADDE 7 YETKİLİ MAHKEME
İşbu sözleşmenin uygulanmasında, Gümrük ve Ticaret Bakanlığınca ilan edilen değere kadar ALICI?nın mal veya hizmeti satın aldığı ve ikametgahının bulunduğu yerdeki Tüketici Hakem Heyetleri ile Tüketici Mahkemeleri yetkilidir.

SATICI şikâyet ve itirazları konusunda başvurularını, T.C. Gümrük Ve Ticaret Bakanlığı tarafından her yıl Aralık ayında belirlenen parasal sınırlar dâhilinde mal veya hizmeti satın aldığı veya ikametgâhının bulunduğu yerdeki tüketici sorunları hakem heyetine veya tüketici mahkemesine yapabilir. Parasal sınıra ilişkin bilgiler aşağıdadır.

1 Ocak 2014 tarihinden itibaren geçerli olmak üzere 4077 sayılı Tüketicinin Korunması Hakkında Kanunun 22 nci maddesinin beşinci ve altıncı fıkralarındaki tüketici sorunları hakem heyetlerinin kararlarının bağlayıcı olacağına ilişkin üst veya tüketici mahkemelerinde delil olacağına ilişkin alt parasal sınır 1.272,19 TL, 1 Ağustos 2003 tarihli ve 25186 sayılı Resmî Gazete?de yayımlanan Tüketici Sorunları Hakem Heyetleri Yönetmeliğinin 5 inci maddesinin üçüncü fıkrasında, büyükşehir statüsünde bulunan illerde faaliyet gösteren il hakem heyetlerinin uyuşmazlıklara bakmakla görevli ve yetkili olmalarına ilişkin alt parasal sınır 3.321,17 TL olarak tespit edilmiştir.

İşbu Sözleşme ticari amaçlarla yapılmıştır.
